The appellant’s claims against the respondents before the High Court was for:
Appellant was employed by the respondents in October, 1993 as a Quarry Maintenance Supervisor and later as a Workshop Engineer on a salary of 78,000.00 Deutschmark per annum or 6,500.00 Deutschmark per month and feeding/maintenance allowance of N1, 000.00 Deutschmark per month among other benefits.
The contract was determined on the 12th October, 1995 by notice of determination of contract dated 12th August, 1995. Appellant claimed that for the period from October 1993 to December, 1994 he was entitled to salary with feeding/maintenance allowances totaling 112,500.00 Deutschmark but during that period the respondents paid the appellant 101,750.00 Deutschmark leaving an outstanding balance of 9,750.00 Deutschmark.
Appellant also claimed that from January 1995 to October 1995 he was entitled to salary with feeding/maintenance allowances of 75,000.00 Deutschmark but was paid 9,000.00 Deutschmark by the respondents leaving a balance of 66,000 Deutschmark.
The suit was entered under the Undefended List and was transferred to the general cause list for accelerated hearing.
Dissatisfied with that decision, the appellant appealed to the Court of Appeal.
